    Milestone Status Update

    Issues outstanding from previous periods

    The IOG:

    1. Noted that the following Milestones outstanding from 30 September 2009 are met for the quarter ending 30 September 2009
      1. S1 8.1.K December 09 requirements met for supply of BUBA and EUBA
      2. S1.8.1 L Wholesale has launched and is using the Service Management Service Desk EOI building block
      3. S1 9.1 C December 09 requirements met for the supply of all UBA Backhaul services
      4. S1.10.1 D New UPC orders based on December 09 requirements
      5. S1 15.1.B Managed Data Service consuming HSNS
    2. Noted that the following Milestone outstanding from the 30 September 2009 Milestone Status Report remains outstanding due to an outstanding complaint
      1. S1 10.1 C December 2009 Requirements met for supply of HSNS and UPC
    3. Noted that with respect to Milestones due 31 December 2009
      1. Telecom has reported that all Enforceable Milestones due for the quarter ending 31 December 2009 were met and two Tracking Milestones were not met being 9.3 Data Compliance and S1 10.1 E UNS over ATM.
      2. The IOGSO agrees that 21 Milestones are Met.
      3. The IOGSO agrees that two Tracking Milestones being 9.3 e (iii) and 9.3 e (iv) with reference to S6 Part A and S1.10.1 E were not met. This is not a breach of the Undertakings as they are Tracking Milestones.
    4. Noted that with respect to Milestones due 1 January 2010
      1. Voluntary Tracking Milestone related to Workforce management design documentation is Met
    5. Noted that the documents received have been reviewed pursuant to clause 79.1 (i) to determine if they indicate any non trivial breach of the undertakings and it is the opinion of the IOGSO that they do not.

    Detailed update on Data Compliance Tracking Milestone 9.3 e iii

    Ms Littlejohn spoke to the paper and noted that:

    • The PROBE data warehouse is the main outstanding system to be reviewed by the IOGSO
    • Workshops have been held concerning the evidence standard for the June and September Milestones
    • A risk based approach has been suggested where absolute separation of data is often not possible due to system design
    • The Honesty Box is being used to capture potential data compliance infringements

    The IOG:

    Noted the contents of the report and asked the Support Office to consider sending Telecom a Letter of Concern on Data Compliance (letter sent 10 June 2010).

    Telecom Operational Separation Update

    Ms Tina Hammond, Mr Mark Knowles, Mr Colin Brown and Mr Ewen Powell joined the meeting to update Operational Separation from Telecom’s perspective.

    Matters covered included:

    • The Quarterly Operational Separation Report to the Commerce Commission and IOG up to 31 March 2010
    • The new variation request dated 24 May 2010
    • Broadband Aggregation (BBA) presentation
    • Retail Next Generation Network (RNGT) presentation
    • Chorus 2010 Milestones Update presentation
    • The timing of variation approval and broad downstream impacts

    Honesty Box Summary

    The IOG:

    1. Noted the contents of this report and its attachment.
    2. Noted there have been no ‘non-trivial’ breaches determined from the Honesty Box submissions reviewed to date in the reporting period.
    3. Noted there have been no new Service Provider complaints received in the reporting period.

    Key Performance Indicators (KPI’s)

    KPI Report – 1 October to 31 December 2009

    The IOG:

    Report had been previously circulated post the 23 February 2010 IOG Meeting owing to Telecom KPI’s not being available at that time.

    The IOG:

    1. Noted the contents of the paper
    2. Noted that five of the 19 areas reported in advance of resale equivalence (due on 31 December 2009), show Telecom as having an advantage over Service Providers, but this should reduce post 31 December 2009.
    3. Noted the percentage of new staff trained in the Undertakings in their first month rose to 59.3%; 20% higher than one year ago.
    4. Noted the (future) 31 December 2011 PSTN migration target of 80% for PSTN lines available with EUBA without POTS has been raised with Telecom as the trend over the last three quarters is not sufficient to meet the target.

    KPI Report –1 January to 31 March 2010

    The IOG:

    1. Noted the contents of the paper
    2. Noted for Resale equivalence; 14 of the 17 areas reported do not show any advantage to Telecom Retail and that the three remaining areas constitute trivial differences as allowed
    3. Noted the percentage of new staff trained in the Undertakings in their first month rose (from 59.3%) to 67.1% and improvement remains a focus for Telecom.
    4. Noted the PSTN migration target for PSTN lines available with EUBA without POTS, continues to show slow progress towards the future target of 80% by 31 December 2011, however Telecom advise that work continues toward meeting this Milestone.

    Other Matters Considered

    HSNS Complaint

    1. The Chairman, Mr Paterson, recused himself from the discussion and any future involvement with the HSNS Complaint.
    2. Mr Paterson left the meeting.
    3. Mr Frow was appointed as Chairman for this aspect.
    4. There was extensive discussion on the complaint.  The Support Office was tasked to follow-up several matters and to amend the draft determination and circulate this to the Members, excluding Mr Paterson.

    Compliance Update

    Ms Vanessa Oakley, Telecom’s Director of Regulation, Competition and Litigation, spoke to meeting:

    1. The List and Data Compliance:
      1. The List has been and continues to be resource intensive
      2. The systems subject to Data Compliance do not always support The List’s level of granularity
    2. KPI training timeliness:
      1. Overall training at 98.5% complete
      2. For new employees, weekly cross checking has been introduced
      3. 64% timeliness for new employee training
      4. target from start date; 75% for 30 days
      5. target from start date; 95% for 60 days
    3. Letter of Concern
      1. Progress on the various letters of concern was noted

    There was a demonstration of the Operational Separation Telecom Staff training module and will send disks to the IOG members.

    Letter of Concern

    The IOG agreed to write a letter of concern to the Telecom Board regarding UCLL Consumption (30 June 2010) and Data Compliance (30 September 2010) milestones (letter sent 10 June 2010).

    Commerce Commission

    Dr Ross Patterson and Mr Reto Bleisch spoke to the meeting on a number of matters including discrimination guidelines, matters arising from the Loyalty complaint and the new variation.

    TUANZ

    Mr Ernie Newman spoke to the meeting on TUANZ background, TUANZ’s impressions of industry issues including the UFB initiative and confirmed that TUANZ was happy with the IOG’s performance.

    Complaints Process

    The IOG approved the revised Complaints Process.

    Annual Report

    The Support Office have commenced planning for the 2010 Annual Report and will broadly follow the 2009 approach and structure.

    Telecom Wholesale

    Mr Matt Crockett and Mr Nick Clarke joined the meeting.  Matters discussed included current Wholesale issues, UFB and discrimination (broadly).  Mr Crockett confirmed there was a sound working relationship with the Support Office.
