IOG Meeting Overview - May 2008
This overview summarises the IOG's monitoring of Telecom's Undertakings compliance, as considered by the IOG at their meeting of 30 and 31 May 2008.
Update on separation day milestones
The IOG has reviewed Telecom’s compliance with separation day milestones including those milestones due within 30 working days of the Undertakings being approved, and considers that Telecom has met the separation day milestones as summarised below.
Access Network Services (ANS) business unit established
- The CEO of Chorus has been appointed and the ANS business unit has been established under the Chorus brand, responsible for providing relevant network access services.
- The Chorus business plan for the period April to June 2008 has been submitted to the Telecom Board.
- Chorus brand and accommodation requirements have been met.
Wholesale business unit established
- The CEO of the Wholesale unit has been appointed and the Wholesale business unit has been established, with responsibility for relevant wholesale services.
- The Telecom Board has approved a policy which provides the Wholesale unit with sufficient influence over those assets which the Wholesale unit does not control, and which are required to deliver relevant wholesale services.
- Wholesale unit accommodation requirements have been met.
- The Wholesale unit has established the required IP interconnection consultation process and NGN consultation programme.
IOG and Support Office established
- The IOG has been appointed and the first meeting was held on 28 and 29 April 2008.
- The IOG Support Office has been established.
Codes of Conduct submitted to IOG
- Telecom has submitted codes of conduct to the IOG.
Management of Chorus and Wholesale Commercial Information
- The IOG considers that Telecom has made employees aware of their obligations with regard to Chorus and Wholesale Unit commercial information in respect of relevant services. The IOG will monitor Telecom’s ongoing compliance with these obligations.
Update on equivalence milestones due up to 31 May 2008
Schedule 1 to the Undertakings sets out 12 programmes of milestones through which Telecom will transition to the required levels of equivalence. The IOG has validated the Schedule 1 milestones due on or before 31 May, as well as reviewed those due in the next quarter.
UCLL and UCLL Co-location Migration Plans
- The soft launch requirements (delivery of services on a small scale for the purposes of testing) of the UCLL STD have been met for both UCLL and UCLL Co-location services.
- The delivery contract for the B2B gateway has been signed. This will enable service providers and Telecom business units to transact with Chorus in an equivalent manner for UCLL.
BUBA and EUBA Migration Plans
- The B2B gateway contract referred to above, will also enable service providers and Telecom business units to transact equivalently with the Wholesale unit for BUBA and EUBA.
HSNS, UNS (Over Ethernet) and UPC Migration Plan
- UNS (over ATM) and UPC are available to service providers.
Resale Services Migration Plan
- Telecom has made the required changes to the way in which Broadband Wiring Only Orders are processed.
Other Legacy Data Services Migration Plan
- As required by 31 December 2007, the Retail unit stopped innovation and selling DSTN, X25, and Netway Integrated Access services to new customers.
Documents provided to the IOG
Codes of Conduct
The IOG has reviewed the codes of conduct proposed by Telecom, and reviewed associated online training material for Telecom staff. The IOG considered the codes to be effective, and has recommended the codes to the Telecom Board. The IOG will monitor Telecom’s performance against the codes, and may recommend future changes to the codes if considered appropriate.
Change of Scope in Chorus' business
Telecom advised the IOG of a change in scope of the Chorus business to include additional field services activities, including on-site installation, maintenance of telecommunications plant and equipment, network design and build, and also physical network planning.
The IOG considers the additional field service activities to be consistent with the robust operational separation of Telecom, noting that where Chorus performs technical or operational work for other parts of Telecom as a result of the change in scope, written arrangements are required between the business units from 1 July 2008.
Chorus' business plan
The CEO of Chorus presented to the IOG the Chorus business plan for the period April to June 2008.
The IOG noted receipt of the Chorus Business Plan, together with certificates issued by the Telecom Board and CEO confirming that their involvement in the development of that plan complies with the Undertakings and is consistent with a robust operational separation of Telecom.
